By purchasing any wine / spirits from Mel and Rose Wine & Spirits, you agree that you are bound by the following Terms and Conditions:

1. All wine/spirits are sold "AS-IS," without any representations or warranties, express or implied, including, but not limited to, as to merchantability, fitness for a particular purpose or the correctness of the catalog or other description of physical condition. Anything "Old" wines are NOT guaranteed for drinkability.
2. All risks of loss and damage to wine passes to you upon shipment of the wine / spirits purchased and we are not responsible for any acts or omissions in connection with the packing or shipping of the wines / spirits or of carriers, whether recommended or selected by us. All wines and or spirits purchased are nevertheless insured for shipping purposes.
3. You shall pay any applicable state and local taxes, or VAT and any applicable compensating use tax of another state or Country which we may be required by law to collect at the time of the payment of the purchase price.
4. In addition to other remedies available to us by law, we reserve the right to impose from the date of sale a late charge of 3% per month on any unpaid amounts.
5. These Terms and Conditions of Sale, as well as your and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of California. You consent to the exclusive jurisdiction with any wine purchased from us. In no event shall our liability ever exceed the purchase price actually paid by you for such wine or spirit.
6. After three (3) attempts to deliver and/or three attempts to notify the recipient, or five (5) business days from the date of shipment, whichever occurs first, the shipment will be returned to us and there will be charge 15% restocking fee. Customers will be responsible for all delivery fee to and from the destination charged by messenger or FedEx for undeliverable orders.
7. FedEx suspension of money-back guarantee is ongoing currently for ALL EXPRESS SERVICES due to the increase in U.S. e-commerce and other effects of the pandemic throughout the world.
8. Up to date information on weather advisories can be found at the National Weather Service. FedEx & UPS cares about your safety and we encourage you to prepare for natural disasters.
9. Disclaimer for all wine/champagne orders on site: In cases where the vintage is no longer available, the most current vintage will be shipped.
10. We are not responsible for typographical errors.
11. All orders received after 2 pm Central time will be processed the Next business Day.
12. Should an item not be available any longer, we reserve the right to replace items shown with items of equal value & Melandrose.com reserves the right, at any time, to change its prices and billing methods for products or services sold, effective immediately upon posting on the site or by e-mail delivery to you.
13. We shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate, or refund, or containing any other incorrect information or typographical errors. Melandrose.com shall have the right to refuse or cancel any such orders whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, melandrose.com shall immediately issue a credit to your credit card account in the amount of the charge.
14. We do not include shipping, handling, foreign duties, or sales tax (where applicable).

16. Our products are packaged in FedEx / UPS approved shipper boxes.
17. For all shipping, Street addresses and phone numbers are required.  We are not able to ship to a P.O.Box.  Signature is also required at the time of delivery.
